Driving license


I. The driving license is a document certifiying the right of any person to drive a vehicle. The description, spesification and sample of the driving license is approved by the relevant executive power authority.
II. There are the following types of driving licenses issued in the Republic of Azerbaijan depending on types of mechanical vehicles:
1) To drive motorcycles, quadricycle, tricycle, automobiles, trams and trolleybuses;
2) To drive tractors and other automotive vehicles.
III. Distinctive mark of the Republic of Azerbaijan in international traffic within the ellipse sign on the driver's license – “AZ” and the following information, numbered with numbers, is displayed:
1. surname of license holder;
2. name and patronymic of license holder;
3. date and place of birth of license holder;
4a. date of issue of license;
4b. expiry date of the license;
4c. name or seal of body issuing the license;
4d. personal identification number of license holder;
5. license number;
6. photo of license holder;
7. signature of license holder;
8. place of residence of license holder;
9. categories (subcategories) of vehicles to which the license holder has the right to drive;
10. date of issue of each category (subcategory);
11. expiry date of each category (subcategory);
12. additional information or limitations (a note on the right to drive with glasses or to drive only vehicles with automatic transmission) on each category (subcategory);
14. Other information on registration or traffic safety (a note on the right of the license holder to drive a vehicle with a blood type or "person with a disability" identification mark).
IV. Driving licenses issued for driving vehicles provided for in paragraph 1 of Part II of Article 34 of this Law, other than the data provided in the third part of this article, the following categories and subcategories of vehicles to which the power of driving right concerns, are rendered on driving licenses issued for driving automobiles and motorcycles:
1) “A1” – to drive the motorcycles, tricycles and light quadricycle with engine, swept volume of which is not more than 125 sq/cm and engine power of which is not more than 11 kw;
2) “A” – to drive all kinds of motorcycles;
2-1) “B1” – to drive quadricycles provided for clause 25-3 of Article 1 of this Law
3) “B” - to drive the following vehicles:
Automobiles not belonging to “A” category, the maximum allowable weight of which is not more than 3.500 kg and the number of seats of which is not more than 8 in addition to the driver’s seat;
Automobiles of “B” category with trailer, the maximum allowable weight of which is not more than 750 kg;
Automobiles of “B” category with trailer, the maximum allowable weight of which is more than 750 kg, but not more than unladen weight of the automobile and with such composition, the maximum allowable weight of which is not more than 3500 kg in whole;
3-1) To drive automobiles not belonging to “C1” – “D” category and “D1” subcategory, the maximum allowable weight of which is more than 3.500 kg, but less than 7.500 kq, as well as automobiles of  “C1” subcategory with trailer, the maximum allowable weight of which is not more than 750 kg;
4) To drive automobiles not belonging to “C” - “D” category, the maximum allowable weight of which is more than 3.500 kg, as well as automobiles of  “C” category with trailer, the maximum allowable weight of which is not more than 750 kg;
4-1) “D1” - to drive automobiles of “D1” subcategory, intended for passenger transportation and the number of seats of which is more than 8, but less than 16 in addition to the driver’s seat, also with trailer, the maximum allowable weight of which is not more than 750 kg;
5) “D” - to drive automobiles of “D” category, intended for passenger transportation and the number of seats of which is more than 8 in addition to the driver’s seat, also with trailer, the maximum allowable weight of which is not more than 750 kg;
6) “BE” - to drive automobiles of “B” category with trailer, the maximum allowable weight of which is more than 750 kg and more than unladen weight of the automobile, also automobiles with trailer, the maximum allowable weight of which is more than 750 kg and with such composition, the maximum allowable weight of which is more than 3500 kg in whole;   
6-1) “C1E” - to drive automobiles of “C1” subcategory with trailer, the maximum allowable weight of which is more than 750 kg and more than unladen weight of the automobile, also automobiles with the maximum allowable weight of which is more than 12.000 kg in whole;  
7) “CE” - to drive automobiles of “C” category with trailer, the maximum allowable weight of which is more than 750 kg;
7-1) “D1E” - to drive automobiles of “D1” subcategory with trailer, the maximum allowable weight of which is more than 750 kg and more than unladen weight of the automobile, with such composition, the maximum allowable weight of which is more than 12.000 kg in whole;  
8) “DE” - to drive automobiles of “D” category with trailer, the maximum allowable weight of which is more than 750 kg;
9) “Tram” – to drive trams;
10) “Trolleybus” – to drive trolleybuses.
V. The period of validity of the license is as follows:
1) For the persons who have reached 60 – 10 years;
2) For persons of 60 and more than that – left period by the time they reach 70;
3) For persons of 70 and more than that – 2 years;
4) For persons having the diseases, the list of which is defined by the respective executive body of Azerbaijan Republic – the period indicated on the medical reference presented by them, but not more than 2 years.
VI. Information on the driving license is written in the state language of the Republic of Azerbaijan and in English.
VII. Owner of the driving license is obliged to securely keep the driving license issued to him/her.
VIII. excluded.
IX. The driving license certifiying the right to drive vahicles with A, B, C, D, CE and DE categories certifies the right to drive vahicles with A1, B1, C1, D1, C1E and D1E accordingly.
 
Issuance, change and return of the driving licenses
 I. Any person intending to get driving license, provided in the first part of the 33rd article of this Law:
1) excluded;
2) should pass theoretical exams on traffic rules and practical exams on vehicle driving habits;
3) should pay fee in the amount as specified by the legislation of Azerbaijan Republic.
I-I. Any person intending to get driving license, may independently prepare theoretical exams on traffic rules and practical exams on vehicle driving habits or be trained in courses for preparing the vehicles’ drivers. Any person intending to get driving license for driving vehicles belonging to other categories, excluding vehicles belonging to categories "A" and "B", subcategories "A1" and "B1", should be trained in a driver training and professional development course.
II. A person intending to get driving license should submit the following documents to the appropriate executive body of Azerbaijan Republic:
1) Identification card of citizen of Azerbaijan Republic (appropriately, registration certificate of a foreigner in the territory of Azerbaijan Republic or identification card of a stateless person for the use within the borders of Azerbaijan Republic);
2) The certificate of the educational institution about the training in volume provided in education plans and programs for preparing the vehicle drivers of appropriate category (subcategory) except for those who have undergone independent training;
3) Medical reference in certified form by respective executive body of Azerbaijan Republic;
4) Payment receipt for issuance of driving license.
III. A person intending to get driving license submits (sends) the documents to the appropriate executive body of Azerbaijan Republic directly or via internet. If the documents meet the requirements specified in Articles 33 and 35 of this Law, the person is informed directly or via the Internet about the date and time of the theoretical and practical examination on traffic rules and driving skills. If the documents don’t meet the requirements specified, the nonconformity elimination procedure is explained to the person. A person has the right to take an exam at the examination-registration point in the area where he lives or resides.
IV. Meeting the demands of age and health state specified by the law
1) Alumni of the courses for training drivers and improving their qualification;
2) Alumni of the higher and secondary educational institutions for training the personnel on specialization “automobile transport vehicles”;
3) Persons prepared independently for theoretical exams on traffic rules and practical exams on vehicle driving may take theoretical exams on traffic rules and practical exams on vehicle driving theoretical exams on traffic rules and practical exams on vehicle driving within three days after applying to the corresponding executive body of Azerbaijan Republic.
IV-I. Acceptance of exams and issuance of driving licenses should be realized as follows:
1) payment of the state duty, fine imposed in case of administrative violation against the rules of traffic and road safety, which have entered into force in respect of the owner of the vehicle or other person entitled to dispose of it, and the execution of which has not been postponed or delayed through only bank, post, plastic card, electronic payment systems or the Internet.
1-1) delivery of documents on cases of administrative offenses against the rules of traffic and traffic safety, which cannot be delivered in accordance with Articles 57.1-57.4 and 97.4 of the Code of Administrative Offenses of the Republic of Azerbaijan;
2) electronic management system for receiving and issuing documents excluding queues;
3) monitors, as well as videocamera in exam hall interactively reflecting acceptance and issuance of documents, as well as exam process;
4) taking theoretical exam through information-communication technologies;
5) use of vehicles equipped with video cameras that record the examination process, the number of which will exclude queues for the practical exams on driving skills, and the date of manufacture of the examination shall not exceed five years.
IV-II. Based on the choice of the person intending to get a driving license entitling him/her to drive a vehicle of category "B", a practical test of driving skills may be given in a vehicle with a mechanical or automatic transmission. A person who successfully passed a practical test on driving skills in a vehicle with a mechanical transmission has the right to drive vehicles with mechanical and automatic transmissions. A person who successfully passed a practical test on driving skills in a vehicle with an automatic transmission has the right to drive vehicles with only automatic transmission.
V. The driving license is issued within 30 minutes by respective executive body of Azerbaijan Republic, to persons successfully passed the theoretical exams on traffic rules and practical exams on vehicle driving habits in exam registration points. Issuance of driving licenses is realized according to the legislation “On examining the persons who intend to get driving license giving the right to drive a vehicle and rules of giving driving licenses” specified by respective executive body of Azerbaijan Republic.
VI. The grounds for changing the driving license are as below:
1) Expiry date of its validity;
2) Changing the name, surname and patronymic of the holder;
3) Inaccuracy disclosure in writing
4) Its becoming useless;
5) Its loss;
6) excluded.
Intention of a citizen of the Republic of Azerbaijan holding a driving license issued by the competent authority of a foreign state in accordance with international agreements to which the Republic is a party to drive vehicles for more than one month from the date of entry into the country;
8) getting a temporary or permanent residence permit in the Republic of Azerbaijan by a foreigner or stateless person holding a driving license issued by the competent authority of a foreign state in accordance with international agreements to which the Republic of Azerbaijan is a party in the field of traffic regulation.
VII. At the request of the holder of the change of driving license, retaining all the categories (subcategories) previously held is carried out without examination within 30 minutes by the relevant executive authority of the Republic of Azerbaijan upon submission of the documents provided for in Part VIII of Article 35 of this Law and payment of fine imposed in case of administrative violation against the rules of traffic and road safety, which have entered into force in respect of the owner of the vehicle or other person entitled to dispose of it, and the execution of which has not been postponed or delayed.
VIII. The following documents are submitted for the change of driving license:
1) Identification card of citizen of Azerbaijan Republic (appropriately, registration certificate of a foreigner in the territory of Azerbaijan Republic or identification card of a stateless person for the use within the borders of Azerbaijan Republic);
2) driving license (except for the case of change of a driving license due to loss);
3) document on payment of state duty defined by the law;
4) Medical reference in the cases provided for in paragraphs 2-4 of Part V of Article 34 of this Law.
State duty is not paid if the reason for changing the driving license is due to inaccuracies in its writing.
IX. The change of driving for the change of prescribed categories (subcategories) in the driving license is carried out in the manner provided for in the first - fifth parts of this article.
X. Centralized registry of information on driving licenses issued by the relevant executive body of Azerbaijan Republic should be carried out.
XI. Any person may apply to the court as specified by this Law, for the reasons of ignoring the application about issuing or changing driving license or delaying such application, as well as, non-admission to the theoretical exams on traffic rules and practical exams on vehicle driving habits.  
XII. Persons, guilty in ignoring the application about issuance or change of driving license or delaying it, groundless non-admission to the theoretical exams on traffic rules and practical exams on vehicle driving habits, as well as in damaging driving license on purpose, stealing it, in its illegal preparation, forging, selling or its illegal use in contravention of the requirements of this Law, are in charge as specified by the legislation of Azerbaijan Republic.  
XIII. When the restriction of the right to drive a vehicle expires, the driving license is returned in the following order:
1) the day of the successful passing of the practical driving test for people whose right to drive a vehicle was restricted for more than one year;
2) For people whose right to drive a vehicle is restricted for a period of one year or less, without examination, on the day of expiration of that period.
 
A driving license issued by responsible authority of foreign state
I. A citizen of the Republic of Azerbaijan has the right to drive vehicles in the field of traffic regulation in the territory of the Republic of Azerbaijan within one month from the date of entering the country based on an unexpired driving license issued by the competent authority of a foreign state in accordance with international agreements to which the Republic of Azerbaijan is a party. A citizen of the Republic of Azerbaijan should change hi /her driving license in accordance with the procedure established by parts VI-VIII of Article 35 of this Law to drive vehicles in the territory of the country for more than that period.
II. A foreigner or stateless person temporarily staying in the Republic of Azerbaijan has the right to drive vehicles in the field of traffic regulation in the territory of the Republic of Azerbaijan within one month from the date of entering the country based on an unexpired driving license issued by the competent authority of a foreign state in accordance with international agreements to which the Republic of Azerbaijan is a party. A foreigner or stateless person should change hi /her driving license in accordance with the procedure established by parts VI-VIII of Article 35 of this Law to drive vehicles in the territory of the country for more than that period.
III. In case of changing the driving license in the cases provided for in parts I and II of Article 35-1 of this Law, a driving license issued by the competent authority of a foreign state shall be returned to that person together with the new driving license.
According to the Law of Azerbaijan Republic “On state due”, for issuance of a driving license or changing of a driving license for motor vehicles – twenty five manats.
For taking the exams for a driving license:
for national and international driving license to drive motor vehicles, tram and trolleybuses – twenty manats.

for re-taking exams for national and international driving license to drive motor vehicles, tram and trolleybuses – ten manats.
